Man Accused Of Running Over Officer With ATV Gets Additional Charge

Suspect Brett Marsh headed to court Wednesday to face charges including aggravated assault on a police officer, but instead additional charges were added, including attempted homicide of the third degree and retaliation for past official acts.

Marsh is accused of running over Windber Police Officer John Rice with an ATV in November.

That's why police and the Somerset County District Attorney's office decided to file more severe charges.

Police said Rice responded to reports of someone trespassing on private property, but ended up leaving in an ambulance with severe leg injuries.

Defense attorney Tom Dickey said he wants to see evidence in a police report that proves Marsh intended to run over Rice, then he'll plan his defense.

Marsh's preliminary hearing was postponed to the end of February.
